Kirk’s practice at Gnarus Advisors focuses on consulting assignments in the growing and changing intersections between science, tort law, corporate law, and insurance, as well as the increasing use of bankruptcies and schemes of arrangement to resolve or limit underlying contingent liability claims.
Kirk’s nearly 30 years of practice have focused on advising a wide range of corporations, associations, and individuals (as both plaintiffs and defendants) on the liability and commercial implications of mass torts. Kirk’s consulting expertise and breadth of vision are founded on the diversity – both in type and setting – and number of mass tort matters he has handled through to outcome. His career includes negotiating for and advising clients on asbestos and other product liability claims, insurance coverage for policyholders, mass tort issues in Chapter 11, and inter-corporate battles regarding “shared” insurance rights, fiduciary duties, product recall obligations, and tort resolution trusts.
Kirk and his clients have gone to judgment in lawsuits and arbitrations involving class certifications, tort litigation trust issues, indemnification rights and obligations, manufacturing and waste disposal operations, government cost recovery claims, and fraudulent conveyances. Kirk has served clients in commercial (e.g. Delaware Chancery) and tort venues (e.g. Madison County) around the country, and in various private arbitrations and overseas claims.
In addition to his consulting work for Gnarus, Kirk also publishes an independent blog – GlobalTort.com, which focuses on global tort claiming, science, cancer, mass tort bankruptcies and insurance.
In December 2011, American Lawyer magazine recognized Kirk as a top lawyer for mass tort litigation.
